You can appeal to the Federal Court, on a question of law, if
you do not agree with a SSAT decision regarding your parental leave
pay review.
SSAT staff cannot provide advice on whether you should or should
not lodge an appeal. You may wish to seek legal advice before
deciding whether to appeal.
Please note that there is a time limit in which to lodge a notice
of appeal to the Federal Court. Appeals to the Federal Court must
be lodged within 28 days of receipt of the SSAT decision (or such
other time as the Court may allow), which is sent to the
applicant's last known postal address. You may wish to contact the
Federal Court for advice as to the process of lodgement of an
appeal to it.
Centrelink also has further appeal rights. This means that if an
applicant's review at the SSAT is successful, Centrelink also has
28 days after receiving the decision of the SSAT in which to decide
whether or not to appeal to the Federal Court on a question of
law.
